These Terms of Use (“Terms”) govern your access to and use of TapGPT and related services (the “Service”) provided by Waterfall Labs LTD (“we”, “our”, or “us”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account and for all activity under it. You must provide accurate and complete information when registering.
You may use the Service only in compliance with these Terms and applicable laws. You agree not to: (a) misuse or attempt to gain unauthorised access to the Service or others’ accounts; (b) use the Service for any illegal or harmful purpose; (c) interfere with or disrupt the Service or its infrastructure; (d) scrape, copy, or resell the Service without permission; or (e) use the Service in any way that could harm us, our users, or third parties.
TapGPT uses OpenAI’s services (including ChatGPT) to provide AI-powered features. Your use of those features is also subject to OpenAI’s terms and policies. We do not control OpenAI’s services, and we are not responsible for their availability, content, or conduct. By using AI features, you agree to comply with:
You must not use the Service or any AI features to generate illegal, harmful, or infringing content, or in violation of OpenAI’s usage policies.
We own or license the Service’s content, design, and technology. We grant you a limited, non-exclusive, revocable licence to access and use the Service for your personal or internal business use in accordance with these Terms. You retain ownership of content you submit; you grant us a licence to use it as needed to provide and improve the Service.
Where the Service includes paid features or subscriptions, additional terms and fees apply. Fees are as stated at the time of purchase. We may change pricing with notice; continued use after changes may constitute acceptance. Refunds are as stated in the applicable payment or subscription terms.
The Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated output may be inaccurate or inappropriate; you use it at your own risk.
To the maximum extent permitted by law, Waterfall Labs LTD and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or one hundred pounds (GBP 100) if no fees apply). Some jurisdictions do not allow certain exclusions or limitations; in such cases our liability is limited to the fullest extent permitted by law.
You agree to indemnify and hold harmless Waterfall Labs LTD and its affiliates, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party rights.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnity) will survive termination.
We may modify these Terms from time to time. We will post the updated Terms on this page and, where appropriate, notify you by email or through the Service. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.
These Terms constitute the entire agreement between you and Waterfall Labs LTD regarding the Service. Our failure to enforce any right or provision does not waive that right or provision. If any provision is held invalid, the remaining provisions remain in effect. These Terms are governed by the laws of England and Wales; you submit to the exclusive jurisdiction of the courts of England and Wales (or, if you are a consumer, the courts of your place of residence as permitted by law).
